About

Alison Castrey's health and social care practice began in the field of schools and children's homes, including 2½ years as 'in house' lawyer for a charity and residential children's home/school for young people with significant medical and behavioural needs. ACL was then set up in 2003 and today focusses primarily on adult health and social care, including from the perspective of commissioners.

  • Solicitor representing the Claimants in successful judicial reviews concerning local authority fees paid to care homes: R (on the application of Forest Care Homes Ltd & Ors) v Pembrokeshire County Council [2010] EWHC 3514 (Admin) and R (on the application of Mavalon Care Ltd and others) v Pembrokeshire County Council [2011] EWHC 3371 (Admin).
  • Acting for the Claimants in the judicial review against all 7 Health Boards in Wales concerning the process for determining the rate of Funded Nursing Care (FNC): Forge Care Homes Ltd & Ors, R (on the application of) v Cardiff & Vale University Health Board & Ors [2015] in the High Court and Court of Appeal. (The case was subsequently appealed to the Supreme Court.)
  • Providing consultation input on behalf of provider organisations in relation to multi-commissioner provider framework contracts.
  • Assistance with challenging CQC and CIW reports.
  • Support in safeguarding procedures.
  • Appeals to the Care Standards Tribunal following cancellation of registration.
  • Defence of prosecutions by regulators.
  • BKM Ltd v BBC [2009] EWHC 3151 (Ch) – application for injunction to restrain broadcast of footage secretly filmed in a care home.
  • Drafting multi-party contract for use by care providers, residents, third parties, local authorities and the NHS for funding care placements.
  • Complaints investigation work for local authorities.
  • Pre-completion audit for 60 bed new build care home in Central London (rated 'Good' on opening)
